Shineray scandal: Chinese woman accused of selling motorcycles that pollute 30 times more

Laboratory tests show, again, that Shineray motorcycles emit harmful gases and Abraciclo demands fleet recall and suspension of sales

The arm wrestling between Shineray and Abraciclo (association of two-wheeled vehicle manufacturers) has gained another chapter. The entity denounces that the Chinese brand sells its motorcycles outside the emission standards determined by legislation.

The manufacturer, on the other hand, claims that Abraciclo conducted the tests partially within the laboratories of its members. To refute the argument, new tests were carried out in a laboratory independent of Marelli.

Hired to repeat the evaluations under stricter protocols, the company reached results similar to those previously obtained by the manufacturers associated with the entity, indicating pollutant emissions above the legal limits in practically all the parameters analyzed.

New report

The new report represents the main evolution of an administrative process that has been underway since January 2026 at the National Consumer Secretariat (Senacon). Until then, the Chinese manufacturer’s strategy consisted of questioning the origin of the evidence produced by Abraciclo, arguing that the tests had been carried out in laboratories belonging to competing companies, which would compromise its impartiality.

Now, however, the results presented by an independent laboratory begin to shift the debate from the alleged partiality of the tests to the technical merit of the irregularities pointed out.

According to the documentation presented by Abraciclo to Senacon, the Shineray motorcycles of the Rio 125 EFI, SHI 175 EFI and JEF 150S models were again acquired in the market, submitted to formal chain of custody control and sent to Marelli’s laboratory for complete repetition of the atmospheric emissions and noise tests.

According to the entity, motorcycles exceeded the legal limits in 63 of the 64 parameters analyzed, registering, in some cases, emissions of polluting gases up to 30 times higher than the limits established by Brazilian legislation. The rates obtained are similar to those found in the trials that gave rise to the complaint.

To AutoPapo, Abraciclo stated that it maintains its position in the face of the statements that persist in all the proceedings of the complaint. The entity stresses the importance of strictly following all standards.

Abraciclo fully maintains its positioning. The process is still in progress at the National Consumer Secretariat (Senacon) and has been constantly updated. In fact, Senacon notified other federal government agencies to also manifest themselves. The complaint remains because we understand that the market should be equal for everyone. All companies need to comply with the same rules. Today, Brazil is a reference in vehicle emissions. It is the only country in Latin America aligned with the main world markets, especially with European emissions regulations. Therefore, any company that wants to operate in the Brazilian market needs to meet the same requirements.”

Sought again, Shineray only informed that the process is being processed under judicial secrecy and that it has already presented all the appropriate manifestations, which is why it would not make further comments.

How the investigation began

The dispute between Abraciclo and Shineray began after the association sent Senacon a representation denouncing alleged irregularities in the manufacture and sale of motorcycles of the Chinese brand, at the end of 2025. The first tests involved seven motorcycles purchased from dealerships and from consumers.

The Rio 125 EFI, JEF 150S, JEF 150S EFI and SHI 175 EFI models have undergone evaluations in laboratories authorized by Ibama to carry out environmental tests. The reports pointed to high emissions of carbon monoxide (CO), hydrocarbons (HC), non-methane hydrocarbons (NMHC), nitrogen oxides (NOx) and noise levels higher than those predicted by the Program for the Control of Air Pollution by Motorcycles and Similar Vehicles (Promot).

In one of the cases, carbon monoxide emissions exceeded 87 thousand parts per million during a test at 2,000 rpm, about 29 times above the limit provided for by Conama Resolution No. 493/2019. In addition to emissions, technicians reported the absence of components considered mandatory for the environmental control system, including catalytic converter, canister and closed crankcase ventilation system. Divergences were also identified in the information provided to consumers about the equipment installed in the vehicles.

For Abraciclo, these non-conformities could represent not only environmental infractions, but also violations of the Consumer Protection Code, for marketing products in disagreement with the approved conditions. The association also highlighted the importance of all motorcycle manufacturers following the current standards related to vehicles.

We are not only talking about emissions rules, but also vehicle safety and homologation standards,” he said. “Regarding emissions, the main requirement is to fully comply with Promot (Program for the Control of Air Pollution by Motorcycles and Similar Vehicles). And this involves: compliance with emission limits; performance of the required tests; preparation of technical reports; presentation of these documents to the environmental authorities.”

The association also questions the total lack of compliance with protocols to place a product that meets the requirements of current legislation. “In addition, there are all the vehicle safety requirements before Senatran. The company cannot arrive in the country, start selling motorcycles and then adapt them to the rules. This entire process needs to take place before commercialization. First, the products need to be approved and licensed. Only after this step is it possible to start sales. All of this needs to be in compliance before the vehicle is put on the market”, points out Abraciclo.

Shineray presented its own tests

When presenting its challenge to Senacon, Shineray adopted a strategy based on two pillars. The first consisted of arguing that all motorcycles sold have a License for Use of the Configuration (LC) regularly issued by Ibama after approval in official tests carried out during the environmental approval process.

According to the manufacturer, its models underwent tests conducted by Dafra Motos Experimental Engineering and China Merchants Testing – Vehicle Technology Research Institute, following a methodology recognized by Brazilian environmental agencies.

The second argument focused on the contestation of the essays presented by Abraciclo. For the company, the reports produced by laboratories belonging to the associated manufacturers could not be considered exempt evidence.

The defense argued that the tests would have been carried out without official inspection, without the participation of Shineray and without guarantee as to the origin of the fuel used, the transport of the motorcycles or the conditions of preservation of the vehicles. The manufacturer also classified the complaint as an attempt to harm a competitor that is not part of Abraciclo.

In its statement, the company highlighted that Honda and Yamaha account for most of the national sales of motorcycles and stressed that the positions of president and vice president of the entity are held by executives of these manufacturers.

“While ABRACICLO and its associates dominate 95% of the national market and enjoy heavy tax benefits in the Manaus Free Trade Zone, charging high prices, Shineray emerges as the only competitor with representativeness capable of challenging this scenario.”

According to Shineray, its operations in Suape (PE), outside the Manaus Free Trade Zone, and its lower price policy would be bothering companies that historically dominate the Brazilian market.

Abraciclo’s rejoinder

After the presentation of the defense, Abraciclo decided to directly face the criticisms related to the methodology of the trials. To do so, he hired Marelli to repeat all the evaluations. The new tests sought to meet precisely the requirements previously made by Shineray itself.

The motorcycles were purchased at different dealerships, had their entire chain of custody monitored by a Notary Office and underwent the laboratory tests provided for in Brazilian technical standards.

According to the documentation sent to Senacon, the results practically reproduced those obtained in the first reports. In the entity’s assessment, this eliminates the main argument used by the manufacturer to try to invalidate the initial tests. More than confirming the high levels of emissions, the new tests would demonstrate that the divergences do not result from methodological flaws or procedural problems, but would be related to the characteristics of the vehicles themselves sold.

Ibama’s statement

Another element recently incorporated into the process was a response sent by Ibama to Abraciclo. After suspecting that the vehicles actually sold could differ from those used during the homologation, the entity requested that the environmental agency present documentation related to the monitoring of serial production.

According to Abraciclo, Ibama reported that it had not located records of the submission of Production Emission Value Reports (RVEP) by Shineray.

“In consultation with the internal records of this Authority, the submission of RVEP by the company SHINERAY DO BRASIL LTDA, referring to the applicable period, was not identified,” he said.

RVEP are documents required periodically to demonstrate that vehicles produced on a large scale continue to present environmental performance compatible with that verified during homologation. Although the absence of these records does not constitute, in itself, definitive proof of technical irregularity, it has become part of the set of elements presented by the association to support the opening of an administrative sanctioning proceeding.

Homologation does not end the discussion

One of the central aspects of the process is the difference between homologation and production compliance. Environmental approval certifies that a given model meets the legal requirements during the tests carried out before commercialization.

However, the legislation also requires permanent control mechanisms to ensure that the units produced in series maintain the same technical characteristics of the homologated vehicle. It is precisely at this point that part of the divergence between the parties is concentrated.

While Shineray maintains that its licenses issued by Ibama demonstrate the regularity of the models, Abraciclo argues that the vehicles purchased in the market have a different behavior from that expected for approved motorcycles.

Next chapters

With the incorporation of Marelli’s new tests and the information obtained from Ibama, Abraciclo once again asked Senacon to open an administrative sanctioning proceeding.

Among the measures requested are the recall of the investigated models, suspension of the sale of motorcycles considered irregular, application of fines and communication of the case to agencies such as Ibama, Inmetro, the Administrative Council for Economic Defense (Cade). Senacon is still analyzing all the documentation presented by the parties.
