App drivers demonstrate against Complementary Law

Drivers demand better formulation of the law; Demonstration gains greater proportions and demands solutions to the problems of the category

App drivers and delivery workers demonstrate in the center of Belo Horizonte, and several other capitals, this Tuesday (14). The movement, which also takes place in other cities in the country, is against the Complementary Bill (PLP) 152/25, which, according to the drivers, regulates work, but only benefits the platforms and the government.

In the capital of Minas Gerais, the drivers left Praça do Papa towards the Legislative Assembly of Minas Gerais. The demonstration, which already addresses issues larger than the PLP, should last until the end of the afternoon.

Complementary Bill 152 of 2025 returned to the agenda after an opinion that changed the text on April 7 and the scheduling of a meeting to discuss the approval of the measure on Tuesday.

The Chamber of Deputies issued a note this morning canceling the meeting.

According to the updated text, the PLP establishes central points such as:

Social Security

  • “Platformized” self-employed worker: is a mandatory insured in the category of individual taxpayer. He pays 5% on his contribution salary, which corresponds to 25% of his gross monthly remuneration.
  • Platforms: the general rule is the payment of 20% on the same calculation basis (25% of the worker’s gross remuneration).
  • Alternative model: platforms can choose to contribute 5% of the gross revenue obtained in the Brazilian market.

Earnings, Fees, and Compensation

  • Nature of earnings: The worker’s earnings are divided into two parts:
  • 25% is considered income (base for taxes and Social Security)
  • 75% is used to cover costs, such as fuel and maintenance
  • Retention fees: Platforms may charge a flat monthly fee or per-service fees. In the case of fee-for-service, the average cannot exceed 30% (or 15% in hybrid models with a monthly fee). The calculation must be done individually every seven days.

Remuneration for deliveries:

  • Per service: floor of R$ 8.50 for journeys of up to 3 km (car) or up to 4 km (motorcycle, bicycle or walking).
  • For time worked: amount not less than the proportional to two minimum wages per hour actually worked (counted from acceptance to delivery).

Gratuities and promotions:

  • Tips must be passed on in full and are not part of the gross remuneration.
  • Discounts and promotions offered by the platform to users cannot be discounted from the worker or used to reduce the fee limit.

Additional benefits

  • Tax benefits: exemption from IPI and IOF on the purchase of national cars and motorcycles for professionals who prove at least 2,000 hours of service in the last 12 months.
  • Microentrepreneur: drivers classified as platformized self-employed workers cannot be individual microentrepreneurs (MEI).

Benefits such as the 30% bonus in December, additional benefits for night work, Sundays and holidays and the possibility of forming a reserve (savings) custody through the platform were excluded from the new version.

Work, security and transparency

  • Justice: it is up to the Labor Court to judge cases involving the contracts of platformized self-employed workers.
  • Insurance: requires platforms to take out life and physical integrity insurance with a minimum capital of R$ 120 thousand.
  • Transparency: ensures the app driver the right to receive detailed reports (by service and consolidated every 30 days), with values, fees and withholdings. Sensitive automated decisions (such as blocks) should be amenable to human review.
  • Duty of diligence: obliges companies to prevent false registrations and guarantee the real identity of the worker.

Rules for punishments

  • Contracts: requires a written and clear contract, defining deadlines, forms of remuneration, obligations of conduct and criteria for the distribution of service offers.
  • Blocks and suspensions: before suspending, blocking or punishing workers, platforms must provide for sanctions in the contract, notify the worker of the facts, grant a deadline for defense and decide only after evaluating it — prohibiting generic and vague clauses.

The new version removed the 12-hour working day, the minimum time of 15 seconds to accept, the mandatory panic button in the app and the right of women to serve only women.

What the protesters say

According to the Chofferando Community, which is part of one of the fronts of the demonstration, the new proposals are not beneficial to workers and are only aimed at taxation.

In a collaborative publication, driver Fábio Cabral states that “PL 152 is a project that does not represent us, does not protect us and only comes to benefit companies and increase the burden on those who already work hard every day”.

In an interview with AutoPapo, driver and content creator Francisco Bianchi clarified that the movement does not want to end regulation, but to make it fair for workers

The main concern of drivers is that the project, as it stands, does not solve the real problems of the category and can still create new ones. There is a strong feeling that decisions are being made without listening to those who are at the front, living the day to day of the races. Issues such as fair minimum remuneration per kilometer, transparency in the transfers of the platforms and balance in the number of active drivers are not being addressed effectively.

In addition, there is fear that the regulation will increase costs or bureaucracy for the driver without ensuring a real improvement in income. In the end, those who are driving want predictability and dignity at work, not just more rules,” said the worker.

The driver also left his opinion on solutions that would actually help the category: definition of minimum gain per kilometer driven that accompanies real costs such as fuel, maintenance and depreciation of the vehicle; transparency of the platforms in relation to the amount paid by the passenger and what is passed on to the driver; more balanced limits on the entry of new drivers, to avoid market saturation and incentives or specific policies for those who work full-time.

Staggering of claims

During the demonstration, the drivers took the opportunity to go beyond what is dealt with in the PLP and demand measures considered fairer for the category.

In a sound car that pulls the train, leaders of the movement question the new taxation model and say that incentives to the category would enable, for example, transport with more quality and newer vehicles.

As they passed in front of the city hall, the demonstrators asked for support, in a tone of protest, to Mayor Álvaro Damião.

Route of the demonstration

App drivers and delivery workers have already arrived at the Belo Horizonte Assembly and concentrate the movement on site. There is no forecast for the end of the demonstration.
