Can the Brazilian flag on the car get a fine? Know the rules to avoid losses during the World Cup

The use of props and decorations in vehicles is tradition, but disrespect for the Traffic Code can result in penalties and points on the CNH

With the World Cup approaching, the festive atmosphere takes over the country and many fans express their support for the Brazilian National Team by decorating the streets, the facades and their own cars. But what for most is nothing more than a celebration can become a headache, with financial loss and even a security risk.

Although the practice of decorating cars, motorcycles, and other vehicles with green and yellow flags, stickers, and props is a national custom, it is still mandatory for citizens to follow the rules provided by law.

The golden rule for fans who want to decorate the vehicle is based on two pillars: the total preservation of the driver’s visibility and the perfect fixation of objects. Therefore, the following criteria must be met:

Flags, rearview mirrors, windows and hood

You can decorate your car with the Brazilian flag, as long as it does not cover the surface of the rearview mirrors and does not obstruct the driver’s field of vision, even when fixed to the windows. This also goes for other types of props.

If they are used exclusively on the back of the rearview mirror fairing, without interfering with the mirror, the practice is considered totally regular and the driver can use it calmly, without fear of suffering some punishment.

If the intention was to cover the hood of the vehicle with the flag, there is no exact regulation provided for by law, so there is no prohibition. However, the same rule mentioned above also applies to this case, because if it is poorly affixed, the fabric can come loose and impair the driver’s visibility.

Paints, adhesives and films

These strategies to make your car look like the Brazilian National Team are allowed by law, but with certain limits. Adhesives, films and paints can be applied, as long as they are restricted to the allowed areas and do not alter the color of the model by more than 50%.

If more than half of the vehicle is covered, the change must appear on the car’s document. In addition, the decoration can never compromise the glazed area essential for drivability and peripheral visibility.

Risks and penalties for the irregular use of props at the World Cup

Disobedience to the established rules entails administrative and financial penalties, which vary according to the level of risk generated in traffic according to the CTB:

  1. Obstruction of vision in mirrors and windows – if the inspection catches props or flags covering rearview mirrors or preventing full visibility through the windows, the driver will be fined for committing a minor infraction with a fine in the amount of R$ 88.38 and addition of three points to the National Driver’s License (CNH) (article 230).
  2. The risk of large flags on the hood – improper installation of the fabrics generates a great risk, as the force of the wind can cause the fabric to come loose, lifting against the windshield and blocking the driver’s view. Another risk is that the flag hangs or even hits another vehicle. In addition, if the prop covers mandatory items such as the license plate or headlights, the severity of the act increases, being a very serious infraction with a fine of R$ 293.47 and seven points on the license (article 230).
  3. Driving holding the flag with your hand – driving the vehicle with only one hand to be able to hold or wave the flagpole with the other is a big risk. The driver is required to drive with both hands on the wheel and anyone who does not comply with this requirement commits a medium infraction with a fine of R$ 130.16 and four points on the CNH (article 252).
