The Brazilian Traffic Code (CTB) establishes a large number of infractions, points on the National Driver’s License (CNH) and traffic fines, which are quite feared by drivers. But, even worse than bearing these losses, is having the CNH revoked.
The revocation of the license is directly linked to the suspension of the right to drive and, in addition to the driver being prohibited from driving for a certain period, he often also has to pay astronomical fines. Difference between revoked and suspended CNH
The suspension of the driver’s license is a punishment determined by the CTB applied when the offending driver reaches a certain amount of points. This can happen when the driver:
- accumulated 40 points or more in a period of 12 months, none of which is very serious;
- accumulated 30 points in the last year, and one infraction was very serious;
- accumulated 20 points in the last year, two or more of which were very serious;
- did not pay the vehicular debts.
In addition, there are traffic conducts provided for by law that cause the license to be suspended immediately, regardless of other scores on the license. These are the so-called self-suspension infractions, which refer mainly to behaviors that directly endanger the lives of drivers, passengers and pedestrians, such as driving under the influence of alcohol or other psychoactive substance that causes dependence.
The revocation, in turn, happens when the driver:
- He continues to drive with a suspended driver’s license;
- Reoffends in specific self-suspension infractions within twelve months;
- He is the target of a judicial conviction for a traffic offense.
If a driver is caught driving with a revoked driver’s license, he will have to answer criminally for his act. To recover the revoked or suspended CNH, the driver needs to go through the rehabilitation process determined by the DMV of his state.
Infractions that can lead to the suspension and revocation of the CNH
According to article 263 of the CTB, a driver’s license may be revoked for recurrence, within twelve months, of the infractions provided for in item III of article 162 and in articles 163, 164, 165, 173, 174 and 175. They are:
