Pardon Law: drivers can have free flow toll fines canceled; see who is entitled

The Traffic and Transport Commission of the Chamber of Deputies analyzes Bill 752/25, which proposes amnesty and the suspension of fines imposed on account of non-payment of free flow tolls. The proposal comes in the midst of the technological transition on Brazilian highways, aiming to correct what the text classifies as a “disproportionality” in the punishments for drivers.

Amnesty and proportionality on highways
Authored by Deputy Pompeo de Mattos (PDT-RS), the bill suggests the suspension of fines imposed in the last 24 months and the forgiveness of infractions that occurred in the period of one year prior to the eventual enactment of the law. The central argument is the financial imbalance: today, the evasion of a low-value fare — such as R$ 10.00 — carries a serious fine of R$ 195.23, in addition to five points on the CNH.
In addition to the pardon, the text provides for the creation of a centralized platform for consultation and settlement of free flow debts. The measure aims to prevent simple forgetfulness from being converted into a traffic violation. The project also reinforces the distinction between the modalities: while the automatic collection via “tags” occurs in exclusive lanes, the free flow system eliminates physical toll plazas, requiring the driver to settle the debt within 15 days on the concessionaire’s website.

Recently, the National Land Transport Agency (ANTT) clarified that there is no generalized suspension of fines in free flow until 2026, denying rumors that circulated on social networks. According to the agency, what occurs is a technical analysis for data integration. Thus, the inspection remains active and the obligation to pay the fare remains full for all users on concession highways.
