Chamber Commission approves end of points on CNH for irregularity in the Blue Zone

Substitute maintains the fine for irregular parking in paid rotating spaces, but eliminates the points in the license and bars the tow truck

The Traffic and Transport Commission of the Chamber of Deputies approved a bill that removes the score on the National Driver’s License from drivers caught in an irregular situation in paid rotating parking spaces, such as the Blue Zone. The proposal also prevents the removal of the vehicle in these cases.

In this type of parking, the driver pays to leave the car in public spaces for a limited period. Under the current rules, stopping in disagreement with the signs is a serious infraction, subject to a fine of R$ 195.23 and the registration of five points on the CNH.

If the bill is approved, the fine will continue to be valid, but the infraction will no longer generate points when it is linked exclusively to the irregular use of the paid rotary card — such as non-payment of the ticket or failure to comply with the allowed time.

The approved text is a substitute by the rapporteur, Deputy Zé Trovão (PL-SC), to Bill 2816/25, by Deputy Rodrigo Estacho (PSD-PR), and to the attached PL 2857/25.

According to the rapporteur, the exemption of points is only valid for the improper use of the paid rotary and does not change the penalties for other infractions provided for in the same article of the Brazilian Traffic Code (CTB). Thus, parking in ambulance spaces, the elderly, people with disabilities or taxis, or in places that compromise the safety and flow of traffic, will continue to generate fines and points.

In the justification, Zé Trovão classified as disproportionate the punishment for those who just forget to pay the Blue Zone fare, especially in the face of much more dangerous conducts, such as driving in the wrong direction. “The point system aims to remove the reckless driver, the one who threatens lives, from traffic,” said the rapporteur.

The parliamentarian also pointed out benefits to professional drivers, who spend more time behind the wheel and are more exposed to the accumulation of points. Since Law 14.071/2020, the limit for the suspension of the CNH is no longer fixed: today it varies between 40, 30 and 20 points in 12 months, depending on the number of very serious infractions committed in the period. Drivers with a paid activity record (EAR) maintain the ceiling of 40 points.

In practice, the text separates the forgetting of a low-value payment from absences that allegedly put road safety at risk. The proposal is being processed in a conclusive manner and will still be analyzed by the Commission on Constitution and Justice and Citizenship (CCJC). To become law, the text needs to be approved by the Chamber and the Senate.
