App driver records passenger masturbating in MG and kicks him out of the car with a stick

A 23-year-old man was arrested in flagrante for sexual harassment after masturbating in the back seat of an app car in Nova Serrana, in the Midwest of Minas Gerais. The case occurred on Saturday, July 18, was recorded by the vehicle’s cameras and gained repercussions after the images circulated on social networks.

The ride had been requested on behalf of a woman, but the one who boarded in the city center was a man, the driver told the press. According to the Military Police report, the 24-year-old professional noticed through the internal rearview mirror that the passenger had his pants down practicing the indecent act. The driver asked him to stop, but the man lay down in the back seat and continued for the rest of the journey.

Driver ended the race and called the PM

When parking in front of the destination address, the driver ended the trip, warned that he would call the police and ordered the passenger to disembark. “You can get out of my car now,” he says in the images. The man remained in the back seat. The driver then got out of the car, went to the back door with a piece of wood in his hand and repeated the order, now under threat of aggression. Only then did the passenger put on his shorts, take his cell phone and get off.

The Military Police was then called and gave the suspect an arrest warrant, who remained silent and did not present his version of the facts. He underwent a body examination and was sent to the Civil Police Station and then to the prison system. The driver gave a statement. The Civil Police opened an investigation and the case remains under investigation. None of the versions released so far identify the transport app used on the trip.

Also according to the bulletin, the suspect’s mother told the police that her son has mental disorders, but did not present a document or medical report proving the condition.

What the law says

Sexual harassment is provided for in article 215-A of the Penal Code, included by Law 13,718, of 2018, and consists of practicing a libidinous act in the presence of someone and without their consent, with the aim of satisfying one’s own desire or that of a third party. The penalty is one to five years of imprisonment, when the act does not constitute a more serious crime.

Before 2018, cases like the one in Nova Serrana were often framed under the misdemeanor of indecent assault, punishable only by a fine. The provision was revoked by the same law that created the new criminal type. The recording made inside the vehicle, now common among app drivers, is what usually sustains the arrest in flagrante delicto in this type of occurrence.
