Does irregular CPF block the CNH? Understand the relationship with debts, rules and services

Posts on social networks have generated alerts among drivers by stating that any pending CPF (Individual Taxpayer Registry) would be enough to block the CNH (National Driver’s License). However, the information simplifies a more complex rule and can mislead the driver.

In practice, having a negative name or financial debts does not prevent the driver from driving or renewing the document. The impediment occurs only in cases of registration irregularities with the Federal Revenue Service or specific judicial restrictions.

No. One of the biggest mistakes is to confuse financial default with pending registration.

Overdue bills, open loans or inclusion of the driver’s name in credit protection agencies (such as Serasa and SPC) do not generate automatic blocking of the CNH. The Federal Revenue Service separates the tax situation (tax debts) from the registration situation. It is fully possible to have tax debts and maintain the status of the CPF as “Regular”.

The blockage in Detran services happens when the traffic agency’s systems perform automatic consultation in the Revenue database and find inconsistencies in the validation of the citizen’s identity.

What situations in the CPF prevent Detran services?

Problems arise when the driver’s document has flaws in the registration. The main causes are:

  • Pending regularization: occurs mainly due to the failure to submit a mandatory Income Tax Return;
  • Suspension of the CPF: generated by incorrect or incomplete registration information in the system;
  • Canceled or null CPF: applied by the Federal Revenue Service in specific situations, such as duplicate registration or fraud;
  • Judicial restrictions: specific orders issued by the courts that affect the exercise of certain rights.

Which CNH services may be affected?

While the CPF is in irregular status, the driver does not lose his license automatically, but is prevented from completing several procedures at state traffic agencies, such as:

  • CNH renewal;
  • Issuance of a duplicate of the document;
  • Inclusion or change of category;
  • Updating of registration data.

Bottlenecks in the regularization of the CPF can generate severe complications for those who have the document close to expiring. According to the legislation of the Brazilian Traffic Code (CTB), the driver can circulate with an expired CNH for up to 30 days. After this period, driving with an expired document becomes a very serious infraction, whose penalties include:

  • Fine in the amount of R$ 293.47;
  • Sum of 7 points in the license;
  • Retention of the vehicle until the presentation of a qualified driver.

How to consult and regularize the CPF situation

Checking the registration status is free and can be done directly on the official portal of the Federal Revenue.

  1. “Regular” status: indicates that there are no pending registrations preventing Detran services.
  2. Status “Pending Regularization”, “Suspended”, “Canceled” or “Null”: requires the correction of the registration before entering the traffic service.

To regularize, the citizen must update their data (such as name or affiliation) or submit overdue Income Tax returns. As soon as the Revenue system processes the update, the traffic agencies will release the validation of the procedures again.
