Fiuk faces up to three months in prison for speeding cars in the garage: understand the case

Singer and actor Fiuk, 35, became a defendant in a criminal case for disturbing the peace after complaints from neighbors of the condominium where he lives, in the Alphaville region, in Barueri (SP). The complaint was filed by the Public Prosecutor’s Office of São Paulo and accepted by the Court on July 7. The defense denies the accusations.
According to the complaint, the artist, drift driver and sports car enthusiast, would have the habit of starting and accelerating vehicles in the garage of the residence during the night and during rest hours, with noises that bothered the residents. The episodes would have occurred between January 2025 and March 2026.
The case was framed under article 42, item III, of the Criminal Misdemeanor Law, which deals with disturbing the work or peace of others by abusing sound instruments. As it is a misdemeanor of lesser offensive potential, the penalty provided for is simple imprisonment from 15 days to three months, or a fine. Becoming a defendant means that the Justice saw enough evidence to open the lawsuit, without a conviction.

Defense denies and refused agreement
On June 30, Fiuk refused a proposal for a criminal settlement presented by the Public Prosecutor’s Office to end the process. The agreement provided for the provision of services to the community or the payment of half a minimum wage to a fund or entity. In a statement, the artist’s legal counsel said that he denies the accusations and preferred that the facts be clarified by the courts, and that he “respects his neighbors, has no intention of causing discomfort to anyone”. The defense also asked for the analysis of the referral of the case to Restorative Justice.
Fábio Jr.’s son races in drift
In addition to his musical and television career, Fiuk, son of Fábio Jr., is known for the practice of drifting, an automobile modality based on controlled drifting and disputed on tracks and closed spaces. In Brazil, the category has competitions organized under the seal of the Brazilian Automobile Confederation (CBA).
The singer keeps cars prepared for the modality, usually rear-wheel drive, such as BMW M3, Nissan 350Z, Chevette and Ford Mustang, and participates in events on closed tracks. On social networks, she has published content about the technique and announced in July a masterclass on the subject. The adaptations required by the drift, such as suspension, steering angle, hydraulic handbrake and structural reinforcement, usually move cars away from the original configuration and weigh on resale.
