The Bill (PL 2364/26) wants to prohibit the use of hidden, camouflaged or unmarked speed cameras on roads across the country. If approved, the proposal ensures that fines recorded for equipment not visible to drivers are annulled, directly changing the Brazilian Traffic Code (CTB).

Presented in the Chamber of Deputies by Deputy André Fernandes (PL-CE), the proposal argues that traffic enforcement should play an educational and preventive role, instead of working as an unexpected punitive instrument.

The proposal aims to make it mandatory to install radars in places that are easy for drivers to see, ensuring greater transparency in road inspection.

Have the fines for hidden radar already been canceled?

No. The presentation of the project does not automatically cancel any fines currently applied. The current rules remain in force while the text is being processed in the National Congress. To become law, PL 2364/26 needs to be analyzed conclusively by the committees of the Chamber of Deputies and then approved by the Federal Senate before presidential sanction.

How does speed enforcement work today?

Today, radar inspection is regulated by Resolution No. 798/2020 of the National Traffic Council (Contran). The rules require technical requirements for validation of infractions:

  • Fixed radars: They must be installed after a prior technical survey and on duly signaled roads with the maximum allowed speed. The equipment must register the image of the offending vehicle.
  • Portable radars: They must be operated by a uniformed traffic agent or competent authority. The regulation already prohibits covert use, requiring that agents and equipment be visible to drivers in predetermined stretches.

The objective of PL 2364/26 is to consolidate this prohibition directly in the CTB, ensuring stronger legal support for the cancellation of irregular fines.

Processing in Congress

PL 2364/26 is being processed in a conclusive manner. If it is approved by the committees designated in the Chamber without appeal for a vote in the Plenary, the text will go directly to the Federal Senate for analysis.
