Chamber approves free rescheduling of CNH exams for health reasons
Proposal reaches medical exams, psychological evaluations and driving tests, steps that today can be charged again for each absence

The Commission on Traffic and Transport of the Chamber of Deputies approved a bill that ensures the candidate for the license the right to reschedule exams and make up classes without paying extra fees when the absence is motivated by a proven health problem. The vote took place on August 17.
Under the current rules, those who fail to attend a stage of the process due to illness or accident may be required to pay again to move forward. The gratuity provided for in the text applies to physical and mental fitness exams, psychological evaluations and theoretical and practical driving tests.
The values at stake are not negligible. At the São Paulo DMV, for example, the medical exam costs R$ 122.17 and the psychological evaluation, R$ 142.53 — charges that are repeated at each rebooking. The complete process of first license, on average, R$ 746.29 only in fees.
Certificate within five working
daysTo be entitled to the benefit, the candidate must present medical justification within five working days after the absence. The document must contain the identification of the health professional, the class council number, the signature and the period in which the patient was unable to attend.
The proposal also prohibits traffic agencies and Driver Training Centers (CFCs) from charging additional amounts specifically due to this rebooking.
The approved text is the substitute of the rapporteur, Deputy Beto Preto (PSD-PR), which unified Bill 4087/25, by Deputy Benedita da Silva (PT-RJ), and PL 4088/25, attached. According to the rapporteur, the intention is to give fairer treatment to involuntary situations. “What is intended is only to guarantee the citizen the right to later carry out the missed stage as a result of a proven health problem,” he said.
The discussion comes to Congress at a time when the qualification process is undergoing the biggest change in decades. Since January, a resolution of the National Traffic Council (Contran) has waived the obligation to enroll in driving school for categories A and B, with the official promise to reduce the cost of the license by up to 80%. The exam fees, however, remain under the responsibility of the state Detrans – and it is exactly on them that the project approved by the commission intends to act.
Next steps
The project will still be analyzed, in a conclusive manner, by the Commission on Constitution and Justice and Citizenship (CCJ). If there is no appeal for a vote in the plenary of the Chamber, the text goes straight to the Federal Senate. To become law, it needs the approval of both Houses.
