A new bill, pending in the Chamber of Deputies, intends to change the rules of vehicle identification to try to stop the advance of fraud and illegal schemes involving motorcycles and other smaller means of transport. Bill 2299/26 establishes the absolute obligation to apply a physical security seal in the attachment of back plates. The measure formally covers not only traditional motorcycles, but also scooters, mopeds, tricycles and quadricycles for road circulation.

According to the justification presented by the author of the proposal, Deputy Milton Vieira (Republicanos-SP), the central intention is to create an additional physical barrier to hinder and discourage illicit practices such as cloning, improper replacement, unauthorized removal and tampering with official identifications. The requirement of the physical security component intends to join forces and act directly in conjunction with the technological resources already in force in the current system, such as the QR Code, keeping them in full operation on the streets.

If the text advances through the legislative stages and is approved definitively, the driver who is caught circulating with a vehicle without the regulated device or transiting with a damaged and broken seal will face harsh administrative sanctions. The bill classifies such conduct directly as a traffic violation considered to be of a very serious nature, whose penalties include the application of a pecuniary fine – a sanction imposed for non-compliance with an obligation or rule that requires the payment of a sum of money – and the consequent administrative measure of removal of the vehicle to yards accredited by the competent bodies.

For the new rule to officially take effect in the national territory, the proposal still needs to go through the usual normative procedures of the National Congress. The text will be analyzed in a conclusive manner by the Traffic and Transport and Constitution and Justice and Citizenship committees of the Chamber of Deputies, later requiring formal approval both in the Plenary of the Chamber and in the Federal Senate.
