Shineray is sued: Brazilian Association alleges irregularities in the assembly of motorcycles

Preliminary investigation was opened in November 2025, but came to light after Abraciclo's public position

Shineray is the target of an administrative proceeding at the Ministry of Justice and Public Security, initiated in November 2025, but which only became public in February 2026, after the Brazilian Association of Manufacturers of Motorcycles, Mopeds, Motorcycles, Bicycles and Similar – Abraciclo – released a manifesto confirming the complaint filed against the manufacturer.

The document accuses the manufacturer of possible serious irregularities in the manufacturing process of the motorcycles, which would compromise the driver’s health and environmental standards.

What Abraciclo’s notification against Shineray says

According to the official notification, the investigation was initiated based on article 55, paragraph 4, of the Consumer Protection Code (Law No. 8,078/1990), Decree No. 2,181/1997 and MJ Ordinance No. 905/2017.

The complaint filed by Abraciclo points out alleged serious irregularities in the manufacturing process of Shineray’s motorcycles, which could generate:

  • Risks to the consumer;
  • Impacts on the environment;
  • Violation of fair competition; e
  • Compromised traffic safety.

According to the document, the entity claims to have received alerts from members about possible technical non-conformities in the products sold.

Technical irregularities pointed out in the complaint

Abraciclo pointed out that the biggest problems in Shineray’s processes would be the absence of catalysts, canisters and crankcase ventilation. Items that are currently very important to keep pollutant emission levels within the required range.

“In order to attribute factual substance to the complaint, Abraciclo pointed out that, in the manufacturing process of motorcycles, it is possible to observe: (i) the absence of a catalyst in the products, which, supposedly, leads to potential non-compliance with the standard that regulates the limits of pollutant emissions; (ii) the absence of a canister, which supposedly puts the environment and public health at risk, without prejudice to the health and individual safety of the consumer; and (iii) the absence of crankcase ventilation, which, supposedly, externalizes serious risks to the health and safety of the consumer, as well as to the community and the environment, in view of the high exposure to compounds harmful to health and the environment”, highlights the notification.

Formal notification to the company

Based on the complaint, Senacon officially notified Shineray to present technical clarifications within 20 calendar days from the receipt of the subpoena.

The company must express itself especially on:

  • The alleged risks to consumer health and safety;
  • Possible excess emissions of pollutants and noise;
  • The conformity of the products with the environmental and technical standards in force;
  • The integrity of the information provided to the consumer.

If the company does not respond, the process may continue with the continuation of the investigation and possible adoption of appropriate legal measures.

In response, the manufacturer stated that it “chooses not to comment on the questions”, but took advantage of the space to clarify “that Shineray do Brasil’s products strictly follow the technical, normative and legal standards required by the competent bodies, being fully regular.”
