Cold water bath: Justice suspends ‘cheap CNH’ and prices may rise

Decision responds to a request from clinics that allege economic unfeasibility with the new values set by the DMV

The Court of Auditors of the State of Minas Gerais (TCE-MG) suspended, in an injunction, the effects of ordinance No. 2002/2025 of Detran-MG (current State Traffic Coordination – CET). The rule, which had come into force at the turn of the year, drastically reduced the values of medical and psychological exams required to obtain and renew the National Driver’s License (CNH). The precautionary decision was issued on Tuesday (3).

The rapporteur of the case accepted the argument that the abrupt reduction in prices was implemented without the proper technical studies of economic impact. The court’s fear is that, with the imposition of below-market values, without proper cost analysis, there would be a mass de-accreditation of clinics, generating discontinuity in the provision of public service and harming drivers.

The disparity between the values is at the heart of the dispute. The suspended ordinance set the cost for the psychological evaluation and for the physical and mental fitness exam at R$ 90. The psychological reexamination would cost R$ 88.72. With the repeal of the measure, the trend is for the rates to return to the levels practiced throughout 2025, when each exam cost around R$ 221.85 in Minas Gerais – an increase of more than 100% in relation to the table that the government tried to establish.

The attempt to reduce costs in Minas Gerais occurred in the wake of a federal movement. The government instituted the “CNH do Brasil” program, aiming to modernize and make access to the license cheaper. Following this guideline, the National Traffic Secretariat (Senatran) had established a national ceiling of R$ 180 for the sum of medical and psychological exams.

The process at the TCE runs under secrecy, but exposes the conflict between the need to relieve the citizen’s pocket and the economic sustainability of the accredited network. While the merit is not definitively judged, the previous rule, which is more onerous for the candidate for the license, applies.
