Traffic fine: 6 unexpected ‘souvenirs’ from the holiday trip

Check out the list of common actions, which seem simple and habitual, but which catch many drivers off guard, as they are infractions

With the arrival of the new year, there are also school vacations, a time when most Brazilians travel with their families, and they often decide to take the car out of the garage and put it on the road to its destination. And what everyone hopes for is to return home with good memories or even some souvenir of the place of the trip, but in fact many end up returning with traffic fines to pay.

The Brazilian Traffic Code (CTB) provides for more than 200 infractions that can be punished with points on the National Driver’s License (CNH), fines and administrative measures. And many of these actions are so common that they go unnoticed, but are still punishable. And on the road, a silly inattention or a simple lack of knowledge can be costly.

1. Walking slowly in the left lane

Many people think that ‘freeing’ the left lane is the talk of people in a hurry in traffic, but in fact it is something provided for by legislation:

Art. 185 – When the vehicle is in motion, fail to maintain it:
I – in the lane assigned to it by the regulatory signs, except in emergency situations;
II – in the right lanes, slow and larger vehicles”

  • Infraction – average (4 points);
  • Penalty – fine (R$ 130.16).

The rule applies both to vehicles that are driving below the maximum allowed, without any traffic or limitation, and to heavy vehicles such as trucks and buses. This attitude is even more essential on the road, where vehicles travel at a higher speed.

2. Driving with your arm out of the car

It is normal for drivers to develop tricks and habits when driving, but you have to be careful, as you may be violating the Traffic Code with one of them. Driving with your arm out of the window, whether from a car, bus, truck, van or any other vehicle, is a traffic violation:

Art. 252 – Driving the vehicle:
I – with the arm outside.

  • Infraction – average (4 points);
  • Penalty – fine (R$ 130.16).

That’s because making a decision that can avoid an accident takes less than a second and having both hands holding the steering wheel considerably increases the chances of your reaction being successful.

3. Carrying people, animals or things on your lap

Another custom that many drivers have is to carry children, pets and objects on their lap or to their left (in the space between the driver and the door) while driving. But this is also an infringing conduct, which can even represent a danger in driving, since the driver will not have the same reaction time if he has other things hindering his mobility or even causing distractions.

In the case of those who carry children and pets on their laps, the case is even more serious, because in cases of accidents, you will be putting these beings at great risk.

Art. 252 – Driving the vehicle:
IIcarrying people, animals or volume to its left or between the arms and legs;

  • Infraction – average (4 points);
  • Penalty – fine (R$ 130.16).

4. Overshoot where the line is continuous

Overtaking consists of using the lane in the opposite direction to take the lead of another vehicle. This is quite common on the roads and allowed, as long as the maneuver is done safely, with good visibility and the signage allows it to be carried out.

But what many drivers do not know or do not realize is the signs that prohibit overtaking:

Art. 203 – Overtaking another vehicle on the wrong side:
V where there is longitudinal road marking of the division of opposite flows of the type double continuous line or single continuous yellow line”

  • Infraction – very serious (7 points);
  • Penalty – fine (5x – R$ 1,467.35).

In other words, overtaking the wrong way when the line/lane that divides the lane is continuous (a straight line without any interruption or dashed) is prohibited.

5. Not signaling the car stopped on the road

When your car breaks down in the middle of the road or a traffic accident occurs, many drivers are so concerned with solving the problem, helping someone or even dealing with the damage that they end up forgetting to put the triangle or other form of signage on the road. And, according to the CTB, failing to do this is a big problem:

According to article 46: “whenever it is necessary to temporarily immobilize a vehicle on the roadbed, in an emergency situation, immediate warning signs must be provided”.

Therefore, the CTB also provides for punishment for those who do not have the car immobilized, but do not signal it:

Article 225 – Failing to signal the road, in order to warn other drivers and, at night, not keeping the external lights on or omitting to take the necessary measures to make the place visible, when:
I – having to remove the vehicle from the roadway or remain on the shoulder;
II – the load is spilled on the road and cannot be removed immediately”

  • Infraction – serious (5 points);
  • Penalty – fine (R$ 195.23).
