Many children are fans of trucks, cars or motorcycles and taking a ride in these vehicles is a dream come true, an opportunity for adventure. However, parents or guardians who fulfill this wish may be committing a very serious traffic violation, which generates a fine, among other losses.
Since April 2021, the Brazilian Traffic Code (CTB) prohibits the transport of children under 10 years of age on motorcycles, scooters and mopeds. Many consider this rule to be an exaggeration, but it should not have any kind of exception for safety reasons. The measure, established by Law No. 14,071/20, aims to reduce the rates of traffic accidents involving this vulnerable public.

V – Driving a motorcycle, scooter and moped carrying a child under ten years of age or who is not, under the circumstances, able to take care of his own safety:
Infraction – very serious;
Penalty – fine (R$ 293.47) and suspension of the right to drive;
Administrative measure – retention of the vehicle until regularization and collection of the driver’s license.
The law says that the suspension time of the right to drive can range from 2 to 8 months and, in the case of recurrence in 12 months, from 8 to 18 months.
Contrary to what many people think, not just anyone can, or rather, is able to ride on the back of a motorcycle. The passenger also has to behave correctly, especially when it comes to posture and positioning.
It is necessary for the pillion rider to know, for example, how to position himself in curves, what are the appropriate clothes for the motorcycle ride and other tips. By following this mode of conduct, it is possible to maintain the safety of those on the motorcycle. Now, if not even adults know this, or can follow the ideal conduct while riding on the motorcycle, let alone children under 10 years old.
In most cases, the little ones do not have enough physical and cognitive development to ensure their safety as passengers on motorcycles. Depending on age and size, the child on the pillion may not be able to balance properly, reach the footrests or hold on tightly to the driver.
All of this greatly increases the risk of falls and serious injuries in the event of an accident. In addition, the weight and movement of the child on the pillion can compromise the stability of the motorcycle, requiring greater skill from the driver to maintain control of the vehicle, especially in maneuvers and curves.
