Kim Kataguiri created a Bill that places prison punishment on modifications to the exhaust of vehicles
Bill 3507/25 has not yet progressed, but it is still in the spotlight. Federal deputy Kim Kataguiri (União/SP) took a stand against the measure on social networks, saying that he will be appointed rapporteur on the PL in the Constitution and Justice Commission (CCJ).
According to Kataguiri, he intends to revert the Bill to the original proposal of the inspection being only for safety items and documentation, removing emissions tests. The justification is to reduce the taxes imposed on drivers.

Despite this position against the emissions tests included in PL 3507/25, Deputy Kim Kataguiri had proposed in September 2025 a bill criminalizing modifications to vehicle exhaust. This is PL 4573/2025, which is still awaiting a rapporteur in the Committee on Traffic and Transport (CVT) of the Chamber of Deputies.
The text of the bill suggests amending the Brazilian Traffic Code (CTB) to “typify as a criminal misdemeanor the recidivism in driving a vehicle with a modification intended for greater noise emission”. This includes vehicles with modifications to the exhaust or with a damaged muffler.
Imprisonment is from 15 to 30 days, along with a fine of R$ 1,000. Currently, the infraction for those who have a damaged silencer or run with free discharge is typified as a very serious infraction with a fine and seizure of the vehicle.
This bill has resurfaced on social media in recent days, despite not having updates on the process since October. Despite being on the networks talking daily about the inspection project, the deputy did not comment on the PL he created to criminalize modifications in exhaust.
The inspection project is still in progress in Congress, and needs to go through the Constitution and Justice Commission (CCJ) of the Chamber of Deputies before going to the Federal Senate.
