The seat belt is one of the most basic and important safety equipment in the vehicle, but there are still people who insist on not using it. This carelessness, according to article 167 of the Brazilian Traffic Code (CTB), is a serious infraction that is usually identified by traffic agents. But, can a radar also fine those who are not using this device?

The answer to this question involves the different types of inspection equipment, which infringing actions are capable of detecting and infrastructure issues.

Regardless of the type of road or situation, the belt is mandatory and the responsibility for its use lies with the driver, who must ensure that all occupants are properly secured. But to identify someone who is not using this equipment, any radar is not enough.

Speed cameras, which are the most common on Brazilian roads, do not have, by themselves, the function of identifying the lack of seat belts. They are programmed to check for infractions such as: speeding, running red lights, stopping on the crosswalk, among others related to circulation.

However, in certain regions of the country, these devices have started to work in conjunction with surveillance cameras equipped with artificial intelligence (AI). These devices can automatically recognize irregular behavior, such as:

  • use of cell phones while driving;
  • transporting children without the appropriate restraint device (car seat, car seat or booster seat);
  • absence of seat belt.

This shows that the technology already makes it possible to apply fines based on image records. However, it is important to note that this inspection is not carried out by the radar alone, but by the cameras integrated into the monitoring systems.

How the monitoring cameras that equip the radars work

This type of inspection is allowed by Resolution 909/2022 of the National Traffic Council (Contran), which authorizes the assessment of various infractions through video surveillance systems.

The cameras, installed at strategic points on the highways, have ultra-defined resolution and can identify details even with very fast vehicles, with speeds of up to 300 km/h. They operate without interference from reflections or low light and the AI analyzes the images in real time and flags possible infractions. The information captured by the tool is confirmed by human agents before the fine.

In this way, the traffic authority can apply the penalty for not wearing a belt as long as there is a clear and indisputable image that proves the irregularity. Thus, when transiting through places that have monitoring cameras equipped with this technology, the driver can indeed be fined if he is not wearing a seat belt.
