‘Silly hand’ driver grabs passenger’s breasts and crashes car in BH

Driver admitted to being distracted by touching passenger's breasts; traffic legislation provides punishment for those who drive with only one hand

An unusual accident caught the attention of the Military Police in Belo Horizonte (MG) this Friday (16). The driver of a passenger vehicle lost control of the steering and collided with the car. When questioned by the police about the dynamics of the accident, the driver presented a surprising justification: he admitted to having been distracted when he took his hands off the wheel to touch the breasts of the passenger who accompanied him.

The case, recorded in a video circulating on social networks, shows the damage caused to the vehicle after the collision. According to the report made to the PM, the moment of intimacy inside the moving car diverted the driver’s focus on the road, culminating in the crash.

Despite the material damage, there was no record of serious injuries. The driver’s sincerity in the police report generated immediate repercussions, exposing the risks of lack of total focus on driving.

Infractions and legal framework

From the point of view of traffic legislation, the driver’s conduct constitutes an infraction, although there is no specific article in the Brazilian Traffic Code (CTB) for “libidinous acts”. The action falls mainly under two legal provisions that punish recklessness and lack of zeal:

  1. Article 169 of the CTB: Driving without attention or without the necessary safety precautions. This is the “umbrella” infraction for various distractions. It is considered a light infraction, with a fine of R$ 88.38 and an increase of 3 points on the CNH.
  2. Article 252, item V of the CTB: Drive the vehicle with only one hand. As the driver admitted to having used his hands for a purpose other than controlling the car (except to change gears or signal), he incurs this infraction. It is classified as average, generating a fine of R$ 130.16 and 4 points in the license.

In cases where distraction generates dangerous driving or threat to third parties, the interpretation of the police authority could, in theory, aggravate the record, but the standard application for momentary inattention falls on article 169.
